Last Thursday, I submitted my dissertation for the Master of Laws (LLM) by Research program at the University of Edinburgh Law School.
The thesis is entitled “Using Citation Analysis Techniques for Computer-Assisted Legal Research in Continental Jurisdictions”. I put the thesis online here as well as on the Social Science Research Network SSRN (see below) so that others can profit from my research. In return, I hope that you will be so kind to provide me with feedback.
Abstract:
The following research investigates the use of citation analysis techniques for relevance ranking in computer-assisted legal research systems. Overviews on information retrieval, legal research, computer-assisted legal research (CALR), and the role of citations in legal research enable the formulation of a proposition: Relevance ranking in contemporary CALR systems could profit from the use of citation analysis techniques. After examining potential previous work in the areas of Web search, legal network analysis, and legal citation analysis, the proposition is further developed into a testable hypothesis: A basic citation-based algorithm, despite all its shortcomings, could be used to significantly improve relevance ranking in computer-assisted legal research. By computing and analysing the distribution of 242,078 headnote citations across 80,195 opinions written by the Austrian Supreme Court of Justice between 1985 and 2008, proof for this hypothesis is presented.

I give a presentation at the “Governance of New Technologies” conference. The conference takes place at the University of Edinburgh from 29-31 March 2009 and is hosted by SCRIPTed, an open-access Journal of Law, Technology & Society.
My presentation is entitled “Preventing Information Overload in Computer-Assisted Legal Research: Ranking Austrian Supreme Court Cases According to Legal Relevance”.

Beim der am 22.1.2009 in Wien statt findenden EU-Informationsveranstaltung “Rechtsinformatik” präsentiere ich meine Überlegungen zur Relevanzsortierung in Rechtsdatenbanken.
Ich beschreibe den Aufbau eines Netzwerkes aller 80.195 Entscheidungen des österreichischen Obersten Gerichtshofes seit 1985, in dem diese durch mehr als 240.000 Zitate aus so genannten Rechtssatzdokumenten verbunden sind. Zum Vergleich präsentiere ich auch ein zweites Netzwerk jener Urteile, die vom OGH selbst in der offiziellen “Sammlung Zivilrecht” (SZ) veröffentlicht wurden.
Ich stelle die Unterschiede der beiden Netzwerk-Graphen dar, und beweise damit die Nutzbarkeit des ersten Graphen zur Relevanzsortierung von OGH Judikatur.

Gemeinsam mit Erich Schweighofer, Christian Szücs sowie Gisela Heindl habe ich den Tagungsband des 11. Internationalen Rechtsinformatik Symposions IRIS 2008 herausgegeben (Amazon.de-Eintrag)
Das 584 Seiten umfassende Buch mit dem Titel “Komplexitätsgrenzen der Rechtsinformatik” ist beim deutschen Boorberg Verlag erschienen und trägt die ISBN-Nummern 3415041301 sowie 9783415041301.

The 12th International Legal Informatics Symposium IRIS 2009 will take place between the 26th and the 28th February 2009 in Salzburg, Austria.
